Abstrak
This research aims to analyze the role of the Civil Registry Office (Dukcapil) of Malinau Regency in preventing child marriage (from the perspective of Law Number 16 of 2019 concerning Marriage).Based on the background, two issues are raised in this study: whether the evaluation conducted by Dukcapil has been effective in reducing the rate of underage marriage and the challenges faced by Dukcapil in addressing underage marriage.This research employs a normative legal research type, using a statutory approach (Statute Approach). Underage marriage is governed by Law Number 1 of 1974 in conjunction with Law Number 16 of 2019 concerning the marriage age limit of 19 years and Law Number 24 of 2013 concerning Population Administration. The Civil Registration Agency (Dukcapil) only registers marriages that meet legal requirements, including court dispensations. Through evaluation of marriage certificate registration and data updates in accordance with Minister of Home Affairs Regulation Number 108 of 2019, it monitors marriage age and supports policies to prevent underage marriage. The Malinau Regency Dukcapil evaluation is effective in providing accurate population data for age verification and preventing age manipulation in marriage registration, but it has not been optimal in directly reducing the number of underage marriages. This is because Dukcapil plays only an administrative role and does not have the authority to reject child marriages that have received marriage dispensations. Its evaluation focuses on service output rather than the impact of reducing child marriage rates. Therefore, its effectiveness depends heavily on cross-sectoral collaboration.
