Tinjauan Yuridis Pengungkapan Tindak Pidana Narkotika Melalui Metode Controlled Delivery
ABSTRACT The problem of Narcotics Crime Cases has several methods for disclosing narcotics crime cases, including Undercover Buy and Controlled Delivery, where these two methods are interrelated in disclosing narcotics crime cases. Undercover buy is a special technique in investigating narcotics crimes in which an investigator acts as a buyer in an illegal transaction activity of buying and selling narcotics, while Controlled Delivery is concluded as a disguise by certain investigators under supervision to be able to immerse themselves in the circulation of narcotics drugs in certain locations. This research intends to answer two questions related to the Juridical Review of Disclosure of Narcotics Crime Cases Using the Controlled Delivery Method. First, what is the mechanism for disclosing narcotics crime cases through the Narcotics Law. Second, obstacles in disclosing narcotics crime cases through the Controlled Delivery method. This research uses normative legal research methods which emphasize collecting data that is related to material from statutory regulations, legal theory, books and other data related to research. The results of the first research show that the mechanism for disclosing narcotics crime cases uses the Undercover Buy method and the Controlled Delivery method. The results of the second research show that the obstacles in disclosing narcotics crime cases are the minimum number of personnel, lack of funds, the implementation time required is quite long, lack of community participation because many people are still afraid of narcotics problems, there is still a gap for investigators to abuse their authority due to from regulations that do not provide specific descriptions and explanations regarding techniques for disclosing narcotics crimes.
